- CFTC news centers on an initial rulemaking process for a federal crypto exchange framework.
- The framework could create an optional CFTC registration route for qualifying crypto platforms.
- The action followed the Senate’s failed Sept. 15 procedural vote on the CLARITY Act.
The Commodity Futures Trading Commission began an early rulemaking process on Oct. 5 for a federal crypto market framework. The agency issued an Advance Notice of Proposed Rulemaking covering Regulation Crypto Asset Transactions and Regulation Crypto Asset Markets.
The initiative could eventually create a federal registration path for crypto platforms operating under the CFTC’s existing authority. However, the agency has not yet proposed the final requirements for either framework.
CFTC News Outlines Proposed Exchange Framework
The proposals in CFTC news comprise Regulation Crypto Asset Transactions (Regulation CTX) and Regulation Crypto Asset Markets (Regulation CAM).

Both would define requirements for CFTC-registered exchanges offering covered crypto assets. The framework would give participating exchanges the option to operate under a single federal market regulatory scheme.
For retail customers, the proposed route would permit trading on a margined, leveraged or financed basis.
The source distinguishes these platforms from ordinary spot exchanges and places them within the CFTC’s jurisdiction. It also states that state-licensed exchanges lack permission to offer the same trading arrangements.
However, the CFTC cannot require all covered crypto assets to trade on its registered platforms without congressional authorization.
That limitation separates the proposals from the Clarity Act described in the account. Accordingly, the initiative would establish a voluntary federal option within the agency’s existing powers.
SEC Interpretation Sets Scope for Crypto Proposals
Earlier this year, the CFTC and SEC issued a joint interpretation addressing the regulatory treatment of crypto assets.
According to CFTC news, the CFTC identified Bitcoin, Ether, and other covered assets as non-securities within its authority. The latest CFTC nyheder aligns with that interpretation, proposing requirements for exchanges handling those assets.
The account contrasts this approach with earlier enforcement actions against crypto exchanges, custodians, and software developers.
Those cases concerned alleged failures to comply with existing laws and regulations. It argues that agencies should have developed rules addressing crypto infrastructure instead, a policy position underlying the proposals.
Former SEC Chairman Gary Gensler previously urged crypto exchanges to register with the securities regulator.
The report says that the route required exchanges to treat listed crypto assets as securities and follow existing securities rules. By comparison, the CFTC proposals would address differences between crypto assets and other commodities.
FTX Collapse Highlights Customer Asset Safeguards
In addition to CFTC news, the account uses FTX’s collapse to explain the proposed framework’s reliance on customer protection.
FTX’s founders fraudulently diverted approximately $8 billion in customer funds to finance proprietary investments. The CFTC and SEC brought charges after the exchange failed.
FTX, BlockFi, and Voyager Digital operated through U.S. subsidiaries holding state money-transmitter licenses.
However, state requirements differ and primarily address payment services rather than financial market operations. Federal trading venue requirements cover manipulation, abusive trading, transparency, conflicts of interest, and protection of customer funds.
Most offshore and state-regulated FTX entities entered bankruptcy, while customer property at its CFTC-registered subsidiary remained divided and secure. That difference forms part of the account’s case for federal exchange safeguards.
This article is for informational purposes only and does not constitute financial, investment, or legal advice. The CFTC initiative remains at an early rulemaking stage, and future requirements may differ from the concepts discussed.
